What should I do after a workplace accident?
- Get the help you need: It is important to seek medical attention immediately. Except in emergency situations, the chosen health care provider must be authorized by the Workers’ Compensation Board. You may also be required to seek medical care from a participating health care provider engaged in a Preferred Provider Organization or Alternate Dispute Resolution program.Your employer will send you notice about this if it applies. It is their job to tell you. You may also be required to get diagnostic tests and medicine from a participating institution as well. This information must be provided to you, in writing, by your employer.
- Notify a supervisor: It is important to notify your supervisor about the injury and how it occurred as soon as possible. While there are many exceptions to the law, you should try to notify your supervisor/employer, in writing, within 30 days of the accident or as soon as you are diagnosed with a work related condition.
- File a claim: It is important that you file a claim as soon as possible. An injured individual should file a Form C-3 and mail it to the closest Workers’ Compensation Board. If a claim is not filed within 2 years, an injured party may lose the right to benefits. Exceptions apply. For example, exceptions include when there is no accident and the work related condition develops slowly and if the insurance company fails to raise the defense of timeliness.
Do I need a workers’ compensation attorney?
Workers’ Compensation claims seem straight forward but certain actions or inaction can put an individual’s benefits in jeopardy. It is important to have an experienced legal professional to guide you through the process and ensure that your rights are protected. An experienced practitioner can ensure that the insurance company is not playing games to support their bottom line. We always look for maximum compensation within the law.
